Placement Bonus - Terms and Conditions
Guarantee of Placement Bonus:
Talent Torch Ltd guarantees that a Placement Bonus will be paid to the candidate if it is explicitly included in the job advertisement for the role they successfully secure, subject to the following terms and conditions.
Definitions:
- Talent Torch Ltd: Refers to the recruitment agency facilitating the placement of candidates on behalf of Clients.
- Client: The company or entity that contracts Talent Torch Ltd to find suitable candidates for their open positions.
- Candidate: The individual placed in a role by Talent Torch Ltd for one of its Clients.
- Placement Bonus: A bonus paid to the candidate by Talent Torch Ltd, subject to the terms outlined herein, following the candidate’s successful placement with a Client.
- Placement Fee: The fee paid by the Client to Talent Torch Ltd for the successful recruitment and placement of a candidate.
- Payment: Refers to the full and successful receipt of the placement fee by Talent Torch Ltd from the Client, which then triggers the distribution of the Placement Bonus to the candidate as per the terms outlined.
- Start Date: The official commencement date of the candidate’s employment with the Client.
- Null and Void: The cancellation or invalidation of the Placement Bonus, resulting in no payment being due.
- Eligibility for Placement Bonus: The Placement Bonus is available to candidates placed by Talent Torch Ltd (“the Company”) in roles for Clients, as described in job advertisements that explicitly state the availability of a placement bonus. Only one bonus can be earned by a candidate in a 12-month period, calculated from the start date of the candidate's last employment secured through Talent Torch Ltd.
- Payment of Placement Bonus
The Placement Bonus is dependent on Talent Torch Ltd receiving full payment of the agreed placement fee from the Client.
- 50% of the Placement Bonus will be paid to the candidate within 14 days after Talent Torch Ltd receives payment from the Client.
- The remaining 50% will be paid to the candidate after they have completed 90 days of continuous employment in the position for which they were recruited, provided Talent Torch Ltd has already received the full placement fee from the Client.
- 50% of the Placement Bonus will be paid to the candidate within 14 days after Talent Torch Ltd receives payment from the Client.
- Condition of Payment
The Placement Bonus will only be paid when the Client pays the placement fee to Talent Torch Ltd.- The candidate must be continually employed by the Client for a minimum period of 90 days, during which time the candidate has not been served notice of termination of employment or given notice of resignation.
- In addition, the candidate must leave an online review of Talent Torch Ltd on Trustpilot (or an alternative review service as directed by Talent Torch Ltd) before receiving the Placement Bonus.
- If the Client fails to make payment or defaults on payment within six months from the candidate’s start date, the Placement Bonus becomes null and void.
- The candidate must be continually employed by the Client for a minimum period of 90 days, during which time the candidate has not been served notice of termination of employment or given notice of resignation.
- Timeline of Payment
Talent Torch Ltd is not liable for delays in receiving payment from Clients. Payment of the Placement Bonus to the candidate will only occur once the Client has fully paid the Company, and will be disbursed to the candidate within 14 days of receipt by Talent Torch Ltd. The timeline for payment to the candidate may vary depending on when the Client settles the invoice with Talent Torch Ltd. - Forfeiture of Bonus
If the Client fails to pay or defaults on their payment obligations to Talent Torch Ltd within a six-month period from the candidate’s start date, the candidate forfeits their right to receive any portion of the Placement Bonus. - Legal Jurisdiction
These terms and conditions are governed by, and construed in accordance with, the laws of England and Wales. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. - Amendments
Talent Torch Ltd reserves the right to amend these terms and conditions at any time without prior notice. Any changes will apply to future placements only and will not affect ongoing placements. - Severability
If any part of these terms and conditions is found to be illegal, invalid, or unenforceable by a court of competent jurisdiction, such part shall be severed from the remainder of the terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall remain in full force and effect. - Client Disclaimer
The Placement Bonus is a discretionary payment provided solely by Talent Torch Ltd and is not connected to, endorsed by, or the responsibility of the Client. The Client holds no obligation, liability, or responsibility for the payment of the Placement Bonus, nor is the bonus implied to be part of any contractual agreement between the Client and the Candidate. Talent Torch Ltd assumes full responsibility for administering the Placement Bonus under the terms outlined herein. - Non-Eligibility for Bonus When Securing Role Through Other Means
If the candidate successfully secures the advertised role through means other than Talent Torch Ltd, such as but not limited to, applying directly to the Client or through other recruitment agencies or job platforms, it is likely that Talent Torch Ltd will not receive payment from the Client. In such cases, the candidate will not be eligible to receive the Placement Bonus, as the bonus is contingent upon Talent Torch Ltd receiving the agreed placement fee from the Client. - Adjustment of Placement Bonus for Role or Salary Changes
If the candidate is successful in securing a role with the Client, but the position or salary differs from the job description or salary bracket as advertised by Talent Torch Ltd, any quoted Placement Bonus may be adjusted accordingly. Since the Placement Bonus is based on the fee received by Talent Torch Ltd, which is linked to the salary secured with the Client, we reserve the right to make necessary adjustments to the Placement Bonus in such instances. The final bonus amount will reflect the revised salary or position and any changes to the payment made to Talent Torch Ltd by the Client.
